Home School Graduation
Utah law recognizes home schooling “if the minor is excused from attendance by the local board of education” because “the minor is taught at home in the subjects prescribed by the State Board of Education in accordance with the law for the same length of time as minors are required by law to be taught in the district schools.” (Utah Code § 53A-11-102(1)(b)(ii).) Many families have strong conscientious objections to asking the local school district for “permission” to teach their children at home. One such family refused to do so for years, until their youngest child finished his high school course work. The family then notified their district that the child had graduated from high school, and should no longer be any of the district’s concern.
Unfortunately, the same school district that disputed this family’s right to home school also claims a right to determine whether or not the minor has completed the work required for graduation from high school. Home schoolers strongly object to giving the local school district the right to determine what constitutes “graduation” from home school programs. Home School Legal Defense Association is working with this family and school district to preserve the parents’ right to determine what constitutes graduation under these circumstances.
