We Agree: Testing Not Required

In January, the superintendent of public instruction requested the opinion of the state attorney general as to whether the Nevada home school regulations required testing of homeschoolers. After reviewing the regulations, Home School Legal Defense Association came to the conclusion that nothing in the regulations mandates testing of homeschoolers to determine if equivalent instruction is taking place and sent its analysis of this issue to the attorney general.

The attorney general's office reached the same conclusion as HSLDA and issued its opinion on April 14, 1997:

"NRS 392.070 [the home school regulations] do not require testing of homeschooled students as the only means to provide written evidence the student is receiving equivalent instruction."

As a result of this opinion, the state board and the advisory council are considering modifying the home school regulations to delete the testing requirement. This would be a tremendous improvement in the home school requirements in Nevada. HSLDA will keep members informed about this important matter.
