MONTANA

School District Seeks Unauthorized Registration

At the beginning of the 2007-2008 school year, a Home School Legal Defense Association member family residing in Lincoln County received a form entitled “Home School Registration Form” from the county superintendent of schools. But the family had already provided notice to the superintendent of their child’s attendance in a homeschool as required by state law.*

HSLDA Senior Counsel Dewitt Black replied to the superintendent on behalf of our member family, informing him that registration of homeschooled students with the local school district is not a legal requirement. Homeschooled students are not public school students, so such registration would be inappropriate. Since receiving Black’s letter, the superintendent has made no further efforts to obtain completion of the registration form.
