Family Told to Follow Virginia Law

A Home School Legal Defense Association member family in Yuma County, the Allers (name changed to protect family’s privacy), recently contacted staff attorney Thomas Schmidt after being told that their overseas transfer was contingent upon compliance with the Virginia homeschool law.

Mr. Aller is employed by the U.S. State Department and was being transferred to Europe. Mrs. Aller contacted the State Department and attempted to clear up the matter. But the officials she spoke to were firm—in order to be cleared to go overseas they would have to comply with Virginia homeschool regulations.

Her next call was to HSLDA. Attorney Schmidt then contacted the appropriate officials on the Allers’ behalf, asked why a family from Arizona was being told to comply with Virginia law, and explained that the state of Virginia had no jurisdiction over the family.

Within days the Allers received a call from the State Department informing them that compliance with the Virginia homeschool law was not required for their overseas clearance.
