Young adventurer draws investigation

The Lewises,* a Home School Legal Defense Association member family in the Orlando area, were subjected to a child neglect investigation when their 3-year-old child wandered out of the house. The child was stopped by a passing motorist, who called the police on his cell phone. Just after the call was placed, the child's 13-year-old brother caught up with him, but the passerby insisted that they all wait for the police.

When the police arrived, they conducted a brief investigation, then turned the matter over to the Florida Department of Children and Families (DCF). Later that day, while the Lewises were out, a DCF social worker tried to visit and left her business card.

The Lewises immediately called HSLDA's legal department to discuss their rights and a proper response to the situation. When the social worker again contacted the family, they directed her to call HSLDA Senior Counsel Christopher Klicka, who explained that the family did not wish to permit a home inspection or allow the social worker to speak privately with the 13-year-old.

The social worker agreed to respect the Lewises' rights and resolve the situation as quickly as possible. She arranged to have a brief conversation with the parents and son. This meeting took place uneventfully.

Due to the Lewises' quick action in calling HSLDA and responding decisively to the social worker, the investigation was closed with minimal impact on the family.
