Special education services for homeschoolers

The 2002 Georgia legislative session is now over, and we are happy to report that at least one homeschool friendly bill was passed, although several others did not make it. House Bill 1590 was signed into law on May 13, 2002, adding a provision to state law that entitles homeschool students to receive the same special education services provided to private school students. The bill text is as follows:

For the purposes of the Individuals with Disabilities Education Act, 20 U.S.C.A. Section 1400, et seq., students enrolled in home study programs meeting the requirements of Code Section 20-2-690 shall be deemed to be private school students and shall be provided with the same special education and related services as students enrolled in private schools.

Senate Bills 42 and 349 and House Bill 1266 also would have affected homeschoolers, as these bills would have made private and homeschool students eligible to participate in any extracurricular program at the local public school. The bills died when the session ended on April 12, 2002. HSLDA takes a neutral position on this type of legislation.
