Non-school participation form

Home School Legal Defense Association recently assisted a member family in Center who received a form from their local school district to complete in connection with their participation in programs under the Improving America's Schools Act of 1994. This form, known as the Non-School Participation form, was developed by the North Dakota Department of Public Instruction and sent out to local school districts to obtain data from home educators. The form notified parents of the opportunity to participate in various federal programs and stated that the form had to be completed by home schooling parents "whether they are participating or not."

In responding to the local superintendent who had mailed the form to home schooling families within the school district, HSLDA pointed out that neither state nor federal law required completion of the Non-School Participation form. HSLDA attorney Dewitt Black, informed the superintendent that 14508 of the Improving America's Schools Act states that, "Nothing in this Act shall be construed to affect home schools."
