Above & Beyond the Law

Clarke Community Schools based in Osceola has been sending out a letter telling home school parents that “Iowa law requires that all students not working with an Iowa-licensed teacher must take an assessment test.”

This is not correct. Home school families also have the option of submitting a portfolio of the child’s work that an Iowa licensed teacher of the parent’s choice has reviewed. Home School Legal Defense Association is working with Superintendent Stephen Waterman to correct this error.

A member family who had begun their home school program and properly filed immunization information in one district moved into the Denver Community School District. The new district asked the family to submit immunization information. Iowa Code Annotated § 299.4 only requires that a family submit immunization information for children being home schooled for the first time. After HSLDA communicated with Denver Community School District personnel and advised them they are not entitled to additional immunization information, the district dropped the matter. — Scott A.
