Religious Freedom Legislation Enacted
    On June 10, 1999, Governor George W. Bush signed into law religious freedom legislation. Sponsored by Senator David Sibley (R-22) and originally designated as Senate Bill 138, the new law adopts the compelling interest test in all cases in which the free exercise of religion is substantially burdened. In order to justify a law which substantially burdens a person’s right of free exercise of religion, the state has the burden of proving that it is the least restrictive means of furthering the compelling state interest. If a person’s exercise of religion has been burdened in violation of the law, the person may assert the violation as a claim or defense in a judicial proceeding. The new law limits the amount of damages which may be awarded by the court to $10,000. A person who prevails in such a proceeding is entitled to also receive attorney’s fees, court costs, and other reasonable expenses incurred in bringing the action.
