False Neglect Charges Dropped
The domestic tranquility of a southeast Kansas home school family was recently shattered by an anonymous report of physical and educational neglect. Although a fine educational program was being conducted in the home, the family was nonetheless subjected to the anguish and humiliation of a social services investigation.
Home School Legal Defense Association attorney Scott Woodruff communicated extensively with the social services worker as negotiations progressed, and with the family to advise them fully of their constitutional rights.
The family ultimately agreed to allow the social services worker to interview the child in the presence of two other persons selected by the family. With these safeguards for the protection of the child during the interview, the social services worker conducted the interview.
As a result of the interview and presentation of other evidence showing no neglect whatsoever, the family was cleared of all charges.
