Schools Insist on Use of State Form
     Home School Legal Defense Association member families in Hawaii continue to be contacted by public school officials because of their failure to use Form OIS-4140—Exceptions to Compulsory Education, after notifying the school officials of their intent to teach their children at home. Use of this form is not mandated by state law.
     Section 8-12-13 of Hawaii Administrative Rules prescribes the procedure for commencing home instruction in Hawaii—filing a notice of intent to home educate with the local public school principal. According to the language of this section, “The notice of intent may be submitted on a department developed form (Form OIS-4140) or in a letter containing the following items: (1) Name, address, and telephone number of the child; (2) Birthdate and grade level of the child; and (3) Signature of the parent.” Nevertheless, some school officials continue to insist that the form be used even though they are in receipt of a letter from the home schooling family containing all of the required information.
     While it is understandable that public school officials would prefer the use of a form providing the notice of intent information, such use may not be required. HSLDA has been able to resolve this difficulty by citing the language of the Administrative Rules to any public school official insisting on the use of Form OIS-4140.
