Free from False Records

On April 7, 1997, Governor Christine Todd Whitman signed into law Senate Bill 608, requiring the Division of Youth and Family Services (DYFS) to expunge records regarding unfounded child abuse or neglect allegations. Before an allegation can be deemed unfounded, it must be investigated by DYFS. The term "unfounded" means that DYFS is satisfied that there is no risk to the safety or welfare of a child.

Given the high percentage of false reports being made to social services, this legislation is an appropriate remedy for parents whose reputations would otherwise be damaged by a continuing record of an unfounded report of abuse or neglect. Several other states have considered such legislation, and, hopefully, many more states will follow in New Jersey's footsteps.
