Test Scores Submission Not Required

Quite a number of member families have notified our office that they are receiving correspondence from school officials indicating that test results are to be submitted to the superintendent at the end of the school year. For those of you who may be new to home schooling this year, we want to inform you and remind other home schoolers that there has been a change in the policy regarding test scores.

Home schoolers are required to test annually and notify the superintendent of plans for testing: test, administrator, and location. However, home schoolers are NOT required to submit the results to the superintendent. Home School Legal Defense Association in conjunction with a member family challenged the state's interpretation of the law that test scores were required to be submitted. In 1994 the State Board of Education requested an opinion from the Minnesota Attorney General. In a memorandum dated November 17, 1994, the State Superintendent notified the local superintendents of the revised department of education policy:

    Home school parents will be encouraged to provide test results … However, home school parents cannot be required to submit more material than is required by Minn. Stat. 120.102.
