HSLDA's Position:
Oppose: Kentucky's No Pass/No Drive law was struck down by the Kentucky Supreme Court because it did not apply to every public school student in the Commonwealth. The old law allowed dropouts to drive in districts that did not operate an alternative education program approved by the Department of Education designed to meet the learning needs of students that were unable to succeed in the regular program. The proposed bill would prohibit dropouts from driving in Kentucky, even if their only reason for dropping out was that they were unable to succeed in the regular program and even if their district had no alternative programs available for such students. The proposed bill would arbitrarily punish some children in some districts.
