House Bill 1049: Authorizes Grandparent Visitation Without Parental Consent

Summary:
House Bill 1049 gives a court virtually unfettered discretion to force grandparent visitation, even to an intact 2-parent household, and even if the parents have never been found to be unfit. This violates the parent's right to direct the upbringing of a child, which may include keeping certain grandparents away from a child for very good reasons. Absent a finding of unfitness, parents have the right to determine with whom and when their children have associations.
