H.Res. 1076: Reaffirmation of Parents’ Fundamental and Constitutional Rights

No action is requested at this time. HSLDA is monitoring this resolution and will provide updates as it moves through Congress.

Background:
This resolution expresses the sense of the House of Representatives on the rehearing of the California court case In re Rachel L., and the House of Representative’s support of parents’ Constitutional right to direct the upbringing and education of their children.

On Feb. 28, 2008, the California Court of Appeal handed down a ruling that would prevent any parent who did not possess a teaching credential from legally homeschooling their children. On March 25, 2008 the California Court of Appeal granted a rehearing in the matter. This resolution commends the California Court for granting rehearing and asks that the Court recognize parents’ constitutional right to direct the upbringing of their children.
