Oley Valley School District v. L Family
School District attempts to force special needs evaluation

Filed: December 9, 2005

Nature of Case: N.L. has been enrolled in public school and private school before finally being homeschooled. The Oley Valley School District initiated due process against the family, trying to force an initial evaluation to determined whether N.L. was eligible for special education services.

Jim Mason pointed out to the school district's attorney that the federal regulations have recently changed to make it clear that school districts are not supposed to go after homeschooled students in this manner. Based on this, the district entered into an agreement with the family to withdraw the due process hearing if the family released the district from any financial liability.

Status: Due process hearing request dismissed January 31, 2006.
